ONMC Privacy Policy:

Your privacy is important to us. NMP, LLC (the "Company"), the entity that owns and operates the OFFICIAL NASCAR® MEMBERS CLUBSM program (the "Club" or the "Program"), utilizes all reasonable efforts to be responsible when gathering your personal information and to protect your privacy. Although this Privacy Policy (the "Policy") is not a contract and does not grant you any legal rights, it does serve as an expression of the Company's commitment to protecting private personal information. Please be advised that the practices described in this Privacy Policy apply only to information gathered through and in connection with the Club and web site and do not necessarily reflect our practices for other sites we may now or in the future operate.

This Policy should answer your questions about the sources and kinds of information we collect, how we use it, when it may be shared with others, and how we safeguard its confidentiality and security. We also provide you with ways to correct the data you provide us and to limit our sharing of this data with third parties. This Policy is applicable to the Program and certain affiliated Company web sites. References to "we", "our" and "us" refer to the Company and its agents, successors and assigns.

INFORMATION WE COLLECT AND HOW WE COLLECT IT
In order to facilitate your experience, and manage our business, we collect and maintain personal information about you. The Company collects customer information from many sources to understand and meet your needs. We collect personal information about you from:

  • You, when you voluntarily provide us with information;
  • Your browser, when you visit our web sites and your browser interacts with us;
  • Your transactions and interactions with Company affiliates, partners, sponsors and service providers; and
  • Other sources, in connection with needs and services at events.

The personal information we collect about you through these various sources may include, but is not limited to:

  • Name, address, telephone number, mobile phone number, date of birth (DOB), country of residence, gender and favorite driver;
  • E-mail addresses, fax numbers, text, SMS and similar messaging numbers, and pager numbers
  • Your Member number, login name, password, password hint and display name;
  • Credit/debit card numbers, including associated billing addresses and expiration dates;
  • Transactional and online activity data pertaining to the Program;
  • Information concerning your interests and/or your use of products and services;
  • Personal information provided via survey, focus groups or other marketing research efforts; and
  • Personal information provided to customers-service representatives to research and resolve issues or question.

You may also be able to submit information about other people. For example, you might submit a person's name and e-mail address to send an electronic greeting card, to send a promotional offer, or to make a gift of a Program membership, and, if you order a gift online and want it sent directly to the recipient, you might submit the recipient's name and address. The types of personally identifiable information that may be collected about other people at these pages include: recipient's name, address, e-mail address, and mobile phone/telephone (and/or text, SMS or other messaging) number.

Depending on the service, you may be asked for additional information to properly service your membership in the Program. For those benefits that require you to submit a reimbursement/rebate claim you will be required to complete a form requesting the information needed to process the claim. Depending on the type of claim and the circumstances surrounding the claim, additional documentation may be required. In most cases, when a claim is submitted to us, the data is transferred to a partner for processing. The claim information submitted and the claim status can be reviewed or updated by sending an e-mail to memberservice@onmc.com

Only persons who provide us with the requested personally identifiable information will be able to order products, programs, and services or otherwise participate in the Program's activities and offerings.

AGGREGATE INFORMATION
In addition to obtaining your personal information, when you use our web sites or the web sites of our affiliates, partners, sponsors or service providers, we may collect tracking information such as your browser type, the type of operating system you use, the name of your Internet service provider, and the pages visited on the site. The Company obtains this information to improve the functionality and user-friendliness of our site and to better tailor our site to our visitors' needs. We also use this information to verify that visitors meet the criteria required to process requests. None of this tracking information identifies you personally; we collect it for reporting onsite activity in the aggregate. For example, we may want to know how long the average user spends on our site or which pages or features get the most attention.

COOKIES AND WEB BEACONS
To enhance your experience with our sites, many of our web pages use "cookies". Cookies are text files we place in your computer's browser to store your preferences. Cookies, by themselves, do not tell us your e-mail address or other personally identifiable information unless you choose to provide this information to us by, for example, registering at one of our sites. However, once you choose to furnish the site with personally identifiable information, this information may be linked to the data stored in the cookie.

We use cookies to understand site usage and to improve the content and offerings on our sites. This technology uses information about your visits to this Web site and the sites upon which we advertise to serve advertisements to you. In the course of serving our advertisements, a unique third-party cookie may be placed or recognized on your browser. We may also use web beacons, provided by our ad serving partner, to help manage our online advertising. These web beacons enable our ad server to recognize a browser's cookie when a browser visits this site and to learn which advertisements or listings bring users to our Web site. The information we collect and share through this technology is not personally identifiable.

SURVEYS
We may also provide survey questionnaires and track your traffic patterns, benefit usage and preferences in a personally identifiable manner, in order to better service your membership in the Program, personalize your service and develop additional benefits that will be of interest to you. Any information gathered from click data, benefit usage, surveys, preferences, log files, cookies and other ways you interact with our company is aimed at servicing your membership in the Program, helping us develop the design and layout of the site, and determining additional benefits and offers that may be of value to members of the Program. Any information gathered from refund/rebate claim forms is used to service your claims.

NETWORK TRAFFIC LOGS
In the course of ensuring network security and consistent service for all users, the Company employs software programs to do such things as monitor network traffic, identify unauthorized access or access to nonpublic information, detect computer viruses and other software that might damage Company computers or the network, and monitor and tune the performance of the Company network. In the course of such monitoring, these programs may detect such information as e-mail headers, addresses from network packets, and other information. Information from these activities is used only for the purpose of maintaining the security and performance of Company's networks and computer systems.

OUR COMMITMENT TO CHILDREN'S PRIVACY
We recognize the importance of protecting the privacy of children. For this reason, we do not collect or maintain information from children we know are under the age of thirteen (13) except as permitted by law. The Company also encourages parents to discuss the Internet with their children and monitor personal information that a child may provide via the Internet

HOW WILL THIS INFORMATION BE USED
The Company does not sell or disclose your personally identifiable information to third parties except to the extent required by law or otherwise in compliance with this Policy. Specifically, please note the following:

We may use the information you provide about yourself to fulfill your requests for our products, programs and services, to respond to your inquiries about our offerings, and to offer you other products, advertisements, programs or services that we believe may be of interest to you.

We sometimes use this information to communicate with you, such as to notify you when you have won one of our contests or when we make changes to our membership agreements, to fulfill a request by you for an online newsletter, or to contact you about your account with us.

We use the information that you provide about others to enable us to send them gifts or cards. From time to time we also may use this information to offer our products, programs, or services to them.

In addition, the Company may use data for administrative and analytic purposes, such as information systems management, accounting, billing, and audits, credit card processing and verification, customer-relations correspondence, and other operation management functions with respect to the Program.

The Company may also provide your personally identifiable information and/or reports to certain program sponsors, National Association for Stock Car Auto Racing, Inc. ("NASCAR"), the owners of www.NASCAR.com, and other contracting parties for their use in connection with the Program and for their independent marketing and/or analytic purposes. These third-parties may send you email, text, SMS or similar messages relating to their products and/or services.

To the extent required by law, we may disclose personally identifiable information to government authorities, or to third parties pursuant to a subpoena or other legal process, and we may also use or disclose your information as permitted by law to protect the rights or property of the Company, the Program, our customers, our web sites, and their users. We also may disclose such information in response to a law enforcement agency's request, or where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our terms of use, or as otherwise required by law.

In addition to the above, we sometimes contract with other companies and individuals to perform functions on our behalf or otherwise in connection with the Program, such as hosting our web sites, distributing promotions or sweepstakes, performing marketing surveys, focus groups, or interviews or promoting other opportunities offered by the Program. These parties may have access to personal information, such as addresses, needed to perform their functions, but are generally restricted from using it for other purposes. We may also disclose this information to third parties, such as employers, who have arranged discounts, purchased travel or other services on your behalf.

We have unique partnerships with individual supplier companies for the purpose of providing the various benefits of the Program. As such, we may be required to exchange information, which may include your e-mail address or similar information, with one or more of these suppliers in order to ensure that you are able to use the service and realize these benefits when you choose to do so. The information exchanged is limited to what is required to meet this purpose.

As we continue to develop our business, we might sell or buy assets. In such transactions, user information generally is one of the transferred business assets. Also, if either the Company itself or substantially all of the Company's assets were acquired, your personal information may be one of the transferred assets.

The Company also uses customer information to identify, develop and market products and services that we believe you will value. From time to time, you may receive offers from Company affiliates or from third-party companies with whom we have a business relationship. These third parties are also subject to confidentiality requirements with respect to your information.

Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot assure you that personally identifiable information that is collected will never be disclosed in a manner that is inconsistent with this Privacy Policy.

We may also disclose personally identifiable information to companies whose practices are not covered by this privacy notice (e.g., other marketers, magazine publishers, retailers, participatory databases, and non-profit organizations) that want to market products or services to you. THIRD-PARTY COLLECTION AND USE OF INFORMATION
We sometimes may offer content (e.g., contests, sweepstakes, or promotions) that is sponsored by or co-branded with identified third parties. By virtue of these relationships, the third parties may obtain personally identifiable information that visitors voluntarily submit to participate in the site activity. We do not have ultimate control over these third parties' use of this information. We may use a reputable third party to present or serve the advertisements that you may see at its Web pages. MANAGING E-MAIL, TEXT, SMS AND SIMILAR COMMUNICATIONS
While a Member of this service, you cannot opt out of e-mail, text, SMS or similar communications related to your Membership or service benefits. To cancel your Membership, and to no longer receive e-mail, text, SMS and similar communications related to your membership, please contact our Member Service center by calling our toll-free number.

Promotional E-mail, text, SMS and similar communications
We would like to keep you informed about e-mail, text, SMS and similar communications that do not relate to your Membership or service benefits ("Promotional Offers") from the Company, our affiliates and from third parties. If you wish to be taken off these mailings, communications and/or telemarketing lists, please uncheck the box labeled "Receive promotional e-mail, text, SMS and similar communications" in the Profile page on our Program web sites.

Please note that we will continue to send you information by mail, e-mail, text, SMS or similar communications that you may find valuable in managing your Program account, such as the availability of special offers and new or upgraded products, services, and member benefits, even if you have unchecked the box for receiving promotional e-mail, text, SMS and similar communications. Without limiting the foregoing, where this policy permits us and/or our affiliates to partners to contact you, such contact may be made by e-mail, text, SMS and/or similar method unless you have unchecked the box for receiving promotional e-mail, text, SMS and similar communications as set forth above.

In addition to this method, which applies to your web site preferences, other companies or offerings pertaining to the Program may require different steps to change your preferences for participation. Please review those other company or offering web pages directly for any additional or different requirements to change your preferences.

DISCUSSION FORUM AND CHAT ROOM USE
If you participate in a Program or Company web discussion forum or chat room, you should be aware that the information you provide there will, by the very nature of the use of a forum or chat room, be made available to others, potentially inside and outside of the Company and its affiliates. Also, please recognize that the individual forums and chat rooms may have additional rules and conditions. Each participant's opinion set forth on a forum or chat room is his or her own and should not be considered as reflecting the opinion of the Company. The information we collect in connection with our online forums and communities is used to provide an interactive experience. We use this information to facilitate participation in these online forums and communities and, from time to time, to offer you products, programs, or services. If you choose to submit content for publication (e.g., questions for an online chat guest), we may publish your screen name and other information you have provided to us (e.g., transcript of the chat, including your question).

SECURITY
Information security is important at the Company. We maintain standard physical, electronic and procedural safeguards in an effort to protect personal information and we regularly review our security standards and procedures to protect against unauthorized access to personal information. We cannot guarantee the security of our database, nor can we guarantee that information you supply will not be intercepted while being transmitted to us through electronic means. We ask that you do your part by maintaining your Internet, Program and web site passwords and access codes as strictly confidential. You should not disclose your Password to third parties. If someone else knows your Password, you may lose substantial control over your personally identifiable information and may be liable for legally binding actions taken in your name by the person using your Password. Therefore, if your Password has been compromised, you should immediately contact Member Service at memberservice@onmc.com. Similarly, while we provide the option to place a "Remember Me" cookie on your machine that allows you automatic login when using that machine, you should not select that option if you are using a public or otherwise unsecured machine (your local library, for instance), as this may give others using that machine access to your benefits or contact information.
E-mails you receive as a member of the Program may include links that provide automatic login. If you forward those e-mails to third parties, you may be providing them access to your benefits or contact information.

LINKS TO OTHER SITES
This Policy is applicable to the Company, the Program, and the associated web sites. Please note that we provide additional links to affiliate, partner and third-party resources we think you will find useful. These links will lead you to sites that may operate under different privacy practices and policies not under the control of the Company. ZigZadz Privacy Policy:

Personal Information

  • Non-Account Activity. You can watch videos on ZigZadZ without having a ZigZadZ Account.
  • Account-Related Activity. Certain other activities on ZigZadZ—like uploading videos, posting comments, or watching restricted videos—require you to have a ZigZadZ Account. We ask for some personal information when you create a ZigZadZ Account, including your email address and a password, which is used to protect your account from unauthorized access. A ZigZadZ Account allows you to access many of our services that require registration.
  • Usage Information. We may record information about your usage, such as when you use ZigZadZ, the channels, groups, and favorites you subscribe to, the contacts you communicate with, and the frequency and size of data transfers, as well as information you display or click on in ZigZadZ (including UI elements, settings, and other information). If you are logged in, we may associate that information with your account. We may use clear GIFs (a.k.a. "Web Beacons") in HTML-based emails sent to our users to track which emails are opened by recipients.
  • Content Uploaded to Site. Any personal information or video content that you voluntarily disclose online (on discussion boards, in messages and chat areas, within your playback or profile pages, etc.) becomes publicly available and can be collected and used by others.

Users

  • If you submit personally identifiable information to us through the ZigZadZ Sites, we use your personal information to operate, maintain, and provide to you the features and functionality of the ZigZadZ Sites, as well as provide special personalized features to you.
  • Your account name (not your email address) is displayed to other Users when you upload videos or send messages through the ZigZadZ Sites and other Users can contact you through messages and comments. Any videos that you submit to the ZigZadZ Sites may be redistributed through the internet and other media channels, and may be viewed by the general public.
  • We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major ZigZadZ Site changes or for customer service purposes).
  • We use both your personally identifiable information and certain non-personally-identifiable information (such as anonymous User usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the ZigZadZ Sites and to create new features, promotions, functionality, and services by storing, tracking, and analyzing User preferences and trends.
  • We use cookies, clear gifs, and log file information to: (a) store information so that you will not have to re-enter it during your visit or the next time you visit the ZigZadZ Sites; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests.

Your Choices

  • You may, of course, decline to submit personally identifiable information through the ZigZadZ Sites, in which case you can still view videos and explore the ZigZadZ Sites, but ZigZadZ may not be able to provide certain services to you. Some advanced ZigZadZ features may, for authentication purposes, require you to sign up for other ZigZadZ services, like MyZigZadZ. The privacy notices of those services govern the use of your personal information associated with them.
  • You may update or correct your personal profile information and email preferences at any time by visiting your account profile page.

Information security

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.

We restrict access to personal information to ZigZadZ employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Data integrity

ZigZadZ processes personal information only for the purposes for which it was collected and in accordance with this Policy or any applicable service-specific privacy notice. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.

Accessing and updating personal information

When you use ZigZadZ services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort
